2025 OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY:  The Swig Venture Sweepstakes (“Sweepstakes”) is open only to legal residents of the United States and the District of Columbia, excluding Florida, New York, and Rhode Island residents, who are 18 years of age or older at the time of Entry.  Employees of Sponsor (defined below), participating vendors (if any), their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising, Sweepstakes, and public relations agencies as well as members of their families and/or those living in the same household as such individuals are not eligible to enter. The Sweepstakes is: (a) governed by these official rules (the “Official Rules”), (b) void where prohibited or restricted by law, and (c) subject to all applicable federal, state, and local laws and regulations.  By entering, you agree that you have read and consent to be bound by these Official Rules, and Sponsor’s Privacy Policy, available here.  Eligibility is conditioned on the acceptance of these Official Rules at time of Entry.

HOW TO ENTER:  The Sweepstakes begins on Monday, March 3, 2025 at 8:00am Pacific Time (“PT”) and ends Saturday, March 8, 2025 at 10:59pm PT (“Sweepstakes Period”), and is designed to give eligible entrants the opportunity to win prizes in accordance with these Official Rules.  To enter, you must satisfy one of the entry methods below:

Complete at least one (1) of the themed daily challenges/activities (each, a “Swig Venture”) detailed below during the Sweepstakes Period (each, a “Venture Entry”):

Obtain an official Sweepstakes entry form, available here (the “Entry Form”), print out and complete the Entry Form, and mail the completed Entry Form to Sponsor at the address provided in these Official Rules (each, an “AMOE Entry”). All AMOE Entries must be postmarked during the Sweepstakes Period.

 (a Venture Entry and an AMOE Entry, each an “Entry”)  

Limit one (1) Entry per Swig Venture per person/per account, regardless of method of Entry. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Entries, all of which are void.  Sponsor’s computer is the official Sweepstakes clock. 

ADDITIONAL ENTRY REQUIREMENTS: Each Entry must also comply with the following:

Any Entry that fails to meet the Sponsor’s specifications may be disqualified at any time in Sponsor’s sole discretion.

Entries that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, non-family-friendly, and/or Entries that otherwise contain inappropriate content or objectionable material may not be submitted and may be disqualified at any time in Sponsor’s sole discretion. 

Entries that contain any viruses, spyware, malware or other malicious components that are designed to harm the functionality of a computer in any way may not be submitted and may be disqualified at any time in Sponsor’s sole and unfettered discretion. 

Entries must not contain any images or personally identifiable information of any person other than you. 

You may not be, nor may you work with parties in conjunction with your Entries who are: 1) represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display your Entry in any media form; or 2) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsor from being able to use the Entry worldwide in all media in perpetuity on a royalty-free basis, without any payment or fee obligations. 

Sponsor reserves the right in its sole and unfettered discretion to disqualify any Entry that it believes violates or potentially violates any of the foregoing requirements or otherwise fails to comply with any provision of these Official Rules. The decisions of the Sponsor on this and all matters pertaining to the Sweepstakes shall be final and binding.

RANDOM DRAWING: On or about March 9, 2025, twenty-five (25) potential winners will be selected in a random drawing from among all eligible Entries received during the Sweepstakes Period (each, a “Winner”). The drawing will be conducted by Sponsor’s representative or designee, whose decisions shall be final and binding in all respects. Potential winner will be contacted via Instagram DM or email and will be asked to provide the necessary information (such as first and last name, mailing address, and/or phone number) to Sponsor.

PRIZE(S): There will be twenty-five (25) prize(s), each consisting of One (1) gold tumbler that can be used for one (1) year of free Swig drinks (MAX: One (1) Swig drink per day for one year) (each, a “Prize”). Approximate Retail Value (“ARV”) of each Prize: $2,200. Total ARV of all Prizes: $55,000. 

Odds of winning the Prize depend on the number of eligible Entries received during the Sweepstakes Period. Any Prize details not specified above will be determined by Sponsor in its sole discretion. 

CONDITIONS OF PARTICIPATION: The Prize is not transferable. Taxes on the Prize are the sole responsibility of Winner(s).  No Prize substitutions or cash redemptions allowed, except by Sponsor, who may substitute a prize of equal or greater value if the advertised Prize becomes unavailable.  Sponsor shall not be held responsible for any delays in awarding the Prize or any component thereof for any reason.  Entry into this Sweepstakes constitutes an entrant’s agreement to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. Potential Winner may be required to sign and return an Affidavit of Eligibility/Liability & Publicity Release and a Confidentiality Agreement within 24 hours following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. In the event that any prize notification message is returned as undeliverable or if no response to the prize notification message is received within the time period stated, or if the potential winner is found ineligible or does not comply with these Official Rules, the Prize may, in the Sponsor’s sole and absolute discretion, be forfeited and awarded to an alternate winner selected at random from among remaining eligible Entries. If Sponsor is unable to confirm a winner after three (3) good faith attempts, the Prize may not be awarded. If the confirmed Winner forfeits the Prize for any reason after confirmation, no alternate winner will be selected.  In no event will more than twenty-five (25) Prizes be awarded for this Sweepstakes. If, for any reason, more than twenty-five (25) prize notifications are sent (or more than twenty-five (25) claims are received), Sponsor reserves the right to award the Prize through a random drawing from among all eligible prize claims received. As a condition of entry, entrants agree that (1) the Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Meta Platforms (Instagram), ByteDance (TikTok), or YouTube ; and (2) any questions, comments or complaints regarding the Sweepstakes will be directed to Sponsor, not to Meta Platforms (Instagram), ByteDance (TikTok), or YouTube. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

RIGHTS GRANTED BY YOU:  By entering this Sweepstakes you understand that Sponsor or anyone acting on behalf of Sponsor or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review, or consent, to use, copy, modify, print, publish, broadcast, distribute, and otherwise make available, worldwide in any media now known or hereafter in perpetuity and throughout the World, your Entry, including, without limitation, the Entry and Winner’s name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, commercial, advertising, public relations and promotional purposes, at any time or times, in all media now known or hereafter discovered without notice, review or approval, and without any further compensation, except where otherwise prohibited by law. For clarity, Sponsor or anyone acting on behalf of Sponsor or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to re-post or otherwise share any social media posts, comments, or other media concerning or related to the Sweepstakes or the Prize. 

RELEASE:  By participating in the Sweepstakes, Winner agrees to release Sponsor, Meta Platforms (Instagram), ByteDance (TikTok), YouTube, participating vendors (if any), and each of their respective parent companies, subsidiaries, affiliates, related companies and advertising, promotions and public relations agencies, and each of their respective officers, directors, employees and agents (“Released Parties”) from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Sweepstakes or with respect to awarding, receipt, possession, use and/or misuse of any Prize.  The Released Parties are not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the Prize.  An entrant may be prohibited from participating in this Sweepstakes if, in Sponsor’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of this Sweepstakes by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Released Parties, or associated agencies or entities.

DISPUTES:  Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Utah. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.

ELIMINATION: Any false information provided within the context of the Sweepstakes by any entrant concerning identity, postal address, telephone number, ownership of right or noncompliance with these Official Rules or the like may result in the immediate elimination of the entrant from the Sweepstakes.  

WAIVER: Entrants hereby waive all rights to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket costs; and (ii) have damages multiplied or otherwise increased.  

LIMIT OF LIABILITY:  Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry or Entry information by Sponsor on account of technical problems or traffic congestion via mobile phone or otherwise. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, act of God, or any other causes which corrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes or any portion thereof at any time, and for any reason without further obligation or advance notice. Sponsor reserves the right, but does not have any obligation, to select winners from eligible Entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process or the operation of the Sweepstakes or acts in violation of these Official Rules or in an unsportsmanlike or disruptive manner. IF, NOTWITHSTANDING THESE OFFICIAL RULES, SPONSOR IS FOUND LIABLE TO AN ENTRANT, THE CUMULATIVE LIABILITY OF SPONSOR TO AN ENTRANT SHALL IN NO EVENT EXCEED THE ARV OF THE PRIZE AS PROVIDED HEREIN. Some jurisdictions do not allow such limitations of liability, so the foregoing limitations shall apply up to the maximum extent permitted under applicable law.

SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

SOCIAL MEDIA SWEEPSTAKES: Pursuant to Meta Platforms (Instagram), ByteDance (TikTok), and YouTube promotion guidelines, this Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, ByteDance, or YouTube. By entering, entrants release and hold Meta Platforms, ByteDance, and YouTube harmless from liability.

NO THIRD-PARTY SPONSOR: This Sweepstakes is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than Sponsor. To enter, entrant must comment on the Daily Swig Post to receive a DM from Sponsor where entrant will play a game of chance (e.g., rolling a die; picking a card; or rock-paper-scissors) (the “DM Game”). A winning DM Game will constitute one (1) entry into the Sweepstakes (each, an “Entry”). 

Limit one (1) Entry per person/per account per day during the Sweepstakes Period (unless otherwise provided by Sponsor at time of Entry). 2025 OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1) ELIGIBILITY: The Swig Scratcher Week Promotion (“Promotion”) is open only to visitors of Participating Stores (defined below) who are legal residents of the United States and the District of Columbia, excluding Rhode Island and New York, who are 18 years of age or older at the time of entry. Employees of Sponsor (defined below), participating vendors (if any), their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising, promotion, and public relations agencies as well as members of their families and/or those living in the same household as such individuals are not eligible to enter. The Promotion is: (a) governed by these official rules (the “Official Rules”), (b) void where prohibited or restricted by law, and (c) subject to all applicable federal, state, and local laws and regulations. By entering, you agree that you have read and consent to be bound by these Official Rules, and Sponsor’s Privacy Policy, available here. Eligibility is conditioned on the acceptance of these Official Rules at time of entry.

2) HOW TO ENTER: The Promotion begins on March 17, 2025 at 9:00am Mountain Time (“MT”) and ends March 22, 2025 at 11:59pm MT (“Promotion Period”), and is designed to give eligible entrants the opportunity to win prizes in accordance with these Official Rules. To enter, you must satisfy one of the below entry methods:
(A) Each day during the Promotion Period, be one of the first one hundred (100) customers to go to a Participating Store at 5:00pm local time to receive one (1) scratcher card. No purchase is required to receive this scratcher card (Max: 1 per day during Promotion Period). You may also buy one (1) Swig tumbler at a Participating Store to receive five (5) scratcher cards (Max: 1 per day during the Promotion Period) (each, a “Store Entry”). For the purposes of this Promotion, all Swig stores are considered “Participating Stores”; or
(B) Obtain an official Promotion entry form, available here (the “Entry Form”), print out and complete the Entry Form, and mail the completed Entry Form to Sponsor at the address provided in these Official Rules to receive six (6) scratcher cards (each, an “AMOE Entry”). All AMOE Entries must be postmarked during the Promotion Period. (Store Entry and AMOE Entry, each an “Entry”). For clarity, limit six (6) scratcher cards per person per day during the Promotion Period, regardless of method of Entry. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Entries, all of which are void. Sponsor’s computer is the official Promotion clock.

3) ODDS OF WINNING: There will be twenty-seven thousand and fifteen (27,015) Prizes (defined below) awarded in this Promotion. Fifteen (15) Entries will win the Gold Tumbler Prize (defined below) and twenty-seven thousand (27,000) Entries will win a Food & Beverage Prize (defined below) (each, a “Winner”, collectively, the “Winners”). The odds of winning the Gold Tumbler Prize are .01%. The odds of winning a Food & Beverage Prize are as follows: 24oz. Swig drink – 5%; Pretzel bite cup – 10%; Large cookie – 5%.

4) PRIZE(S):
A. Gold Tumbler Prize (15 TOTAL): One (1) Gold Tumbler that can be used for one (1) year of free Swig (Max: One (1) Swig drink per day for one year) (the “Gold Tumbler Prize”). Approximate Retail Value (“ARV”) of each Gold Tumbler Prize: $2,200;
B. Food & Beverage Prize (27,000 TOTAL):
  a. One (1) 24 oz. Swig drink (ARV: $4.00) (6,750 Total);
  b. One (1) pretzel bite cup (ARV: $4.25) (13,500 Total); or
  c. One (1) large cookie (ARV: $2.25) (6,750 Total)
(each, a “Food & Beverage Prize”). (Gold Tumbler Prize and Food & Beverage Prize each, a “Prize”). Total ARV of all Prizes: $132,564. Any Prize details not specified above will be determined by Sponsor in its sole discretion. In the case of printing error that causes more than 15 Gold Tumbler scratcher cards to be printed, only the first 15 Gold Tumbler scratcher cards that are redeemed will win. FOR AVOIDANCE OF DOUBT, ONCE 15 GOLD TUMBLER SCRATCHER CARDS ARE REDEEMED, THE PROMOTION PERIOD WILL END AND SPONSOR WILL NOT ACCEPT ANY MORE ENTRIES INTO THE PROMOTION.

5) CONDITIONS OF PARTICIPATION: The Prize is not transferable. Taxes on the Prize are the sole responsibility of Winner(s). No Prize substitutions or cash redemptions allowed, except by Sponsor, who may substitute a prize of equal or greater value if the advertised Prize becomes unavailable. Sponsor shall not be held responsible for any delays in awarding the Prize or any component thereof for any reason. Entry into this Promotion constitutes the entrant’s agreement to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Promotion. In no event will more than 15 Gold Tumbler Prizes and 27,000 Food & Beverage Prize(s) be awarded. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

6) RIGHTS GRANTED BY YOU: By entering this Promotion you understand that Sponsor or anyone acting on behalf of Sponsor or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your Entry, including, without limitation, the Entry and Winner’s name, likeness, image, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

7) RELEASE: By participating in the Promotion, Winner agrees to release Sponsor, participating vendors (if any), and each of their respective parent companies, subsidiaries, affiliates, related companies and advertising, promotion and public relations agencies, and each of their respective officers, directors, employees and agents (“Released Parties”) from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Promotion or with respect to awarding, receipt, possession, use and/or misuse of any Prize. The Released Parties are not responsible for any typographical or other error in the printing of the offer, administration of the Promotion, or in the announcement of the Prize. An entrant may be prohibited from participating in this Promotion if, in Sponsor’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of this Promotion by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Released Parties, or associated agencies or entities.

8) DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Utah. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.

9) ELIMINATION: Any false information provided within the context of the Promotion by any entrant concerning identity, postal address, telephone number, ownership of right or noncompliance with these Official Rules or the like may result in the immediate elimination of the entrant from the Promotion.

10) WAIVER: Entrants hereby waive all rights to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket costs; and (ii) have damages multiplied or otherwise increased.

12) SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

HOW TO ENTER: The Sweepstakes begins on Monday, March 24, 2025 at 9:00am Mountain Time (“MT”) and ends Saturday, March 29, 2025 at 11:59pm MT (the “Sweepstakes Period”), and is designed to give eligible entrants the opportunity to earn entries by participating in daily Swig-themed puzzles or riddles on Instagram.

Daily Keyword & DM Gameplay: Each day during the Sweepstakes Period, Sponsor may post or reveal a “keyword” on its official Instagram account (@swigdrinks). By sending the day’s keyword via direct message (“DM”) to Sponsor, participants will have an opportunity to engage in one or more puzzles, riddles, or challenges (collectively, the “Daily Puzzles”). Correctly solving a Daily Puzzle, as determined by Sponsor in its sole discretion, may earn a participant a certain number of entries (ranging from zero (0) up to six (6) entries) for that day. The number of entries available may vary by day or puzzle.

Additional Entry Opportunities: At times, Sponsor may allow participants to retry or earn extra entries for certain Daily Puzzles by taking additional actions on Instagram (e.g., reposting Sponsor’s content to Instagram Stories). All such opportunities and requirements will be communicated by Sponsor at its sole discretion.

Entry Limit / Per-Person Prize Limit: There is no guaranteed minimum number of entries a participant may earn; some participants may earn zero (0) entries on a given day if they do not solve the puzzle correctly or if they choose not to participate that day. While a single participant may accumulate multiple entries throughout the Sweepstakes Period, only one (1) prize may be awarded per person.

No Purchase Required: No purchase or store visit is necessary. The entire Sweepstakes is hosted via Instagram DMs, and all puzzle information needed to solve challenges is publicly available.

Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, all of which are void. Sponsor’s computer is the official Sweepstakes clock.

ADDITIONAL ENTRY REQUIREMENTS: Each Entry must also comply with the following:

Any Entry that fails to meet the Sponsor’s specifications may be disqualified at any time in Sponsor’s sole discretion.

Entries that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, non-family-friendly, and/or Entries that otherwise contain inappropriate content or objectionable material may not be submitted and may be disqualified at any time in Sponsor’s sole discretion.

Entries that contain any viruses, spyware, malware or other malicious components that are designed to harm the functionality of a computer in any way may not be submitted and may be disqualified at any time in Sponsor’s sole and unfettered discretion.

Entries must not contain any images or personally identifiable information of any person other than you.

You may not be, nor may you work with parties in conjunction with your Entries who are: 1) represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display your Entry in any media form; or 2) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsor from being able to use the Entry worldwide in all media in perpetuity on a royalty-free basis, without any payment or fee obligations.

PRIZE(S): There will be twenty-five (25) prize(s), each consisting of One (1) gold tumbler that can be used for one (1) year of free Swig drinks (MAX: One (1) Swig drink per day for one year) (each, a “Prize”). Approximate Retail Value (“ARV”) of each Prize: $2,200. Total ARV of all Prizes: $55,000.

Odds of winning the Prize depend on the number of eligible Entries received during the Sweepstakes Period. Any Prize details not specified above will be determined by Sponsor in its sole discretion.
